Spanish Citizenship by Descent — Also Known as "By Option"
Spanish law calls this route citizenship "por opción," by option, the technical term for claiming nationality through a specific legal link: a Spanish parent, adoption, or birth in Spain under the conditions above. You'll see "by descent" and "by option" used interchangeably, they refer to the same legal mechanism.

The Democratic Memory Law — Closed October 2025
This law let descendants of Spaniards exiled under Franco claim citizenship directly, without residency. By the time applications closed on 22 October 2025, consulates had received over 876,000 applications, more than 95% of them through consulates in Latin America and Miami. If you'd already booked your appointment before the deadline, your case can still proceed. If you hadn't, this specific route is closed to you now.
The Sephardic Law (12/2015) — Closed Since 2019
A separate, older law allowed descendants of Sephardic Jews expelled from Spain in 1492 to claim citizenship. That application window closed on 1 October 2019, permanently. It's a different law from the Democratic Memory Law above, though the two get confused often.
THE GENERATION GAP
Spanish Citizenship Through Great Grandparents — Why This Route No Longer Exists
There's no current path for great-grandchildren to claim Spanish citizenship by origin directly. The Democratic Memory Law was the route that made this possible for exile descendants, and it's now closed to new applicants. If you're a great-grandchild of a Spaniard without a closer, living relative who's already registered, origin-based citizenship generally isn't available to you today.
Grandchildren Now Generally Need 1 Year of Residence
Grandchildren without a parent who registered as Spanish typically no longer qualify for direct attribution without residency. Most now go through naturalisation instead, requiring one year of legal residence in Spain, still faster than the standard ten years, but not the residency-free route some outdated guides still describe.
