If at least one parent was themselves born in Portugal and is resident there at the time of the birth, the child qualifies as Portuguese by origin, with no minimum residency period required. This is a distinct legal route from the one below, and a lot of guides online blend the two together incorrectly.

A Parent Not Born in Portugal — 5 Years of Legal Residence Required

If neither parent was born in Portugal, a child born there can still be Portuguese by origin if, at the time of birth, one parent has legally resided in Portugal for at least 5 years. What counts is the residence title, not just physical presence, a couple who arrived 6 years ago but only received their residence permit 4 years ago doesn't meet this requirement, because the 5 years are measured from the title, not the arrival date. This route also requires an active step the previous ones don't: the parents need to formally declare that they want the child to be Portuguese. It isn't automatic the way it was before 2026.

Why the Date of Birth Matters — Which Version of the Law Applies

The 5-year requirement only applies from 19 May 2026 onward. If your child was born before that date, the previous rule, generally one year of legal residence, applies instead. It's the law in force on the date of birth that governs, not the law in force today.
