Children of Spanish Parents — Never a Residency Requirement
If one of your parents was a Spanish citizen when you were born, you're Spanish by origin, automatically, with no residency requirement, regardless of where you were born or where you live now.
Grandchildren — The Direct Route Has Closed for New Applicants
This is where a lot of outdated guidance causes real problems. Grandchildren used to have a direct path to citizenship without living in Spain, through the Democratic Memory Law. That specific route is now closed to new applicants. Today, most grandchildren without a parent who registered as Spanish need to go through residency-based naturalisation instead, typically the reduced two-year route if eligible, which does require actually living in Spain.
A CLOSED CHAPTER
The Democratic Memory Law — Closed to New Applications
The Democratic Memory Law, known informally as the "Ley de Nietos," allowed descendants of Spaniards exiled under the Franco dictatorship to claim citizenship directly. The deadline for new applications closed on 22 October 2025.
If You Already Had an Appointment Before October 2025
If you booked your consulate appointment before the deadline, you can still complete your application, even if the appointment itself falls later, in some cases as late as 2029. If you hadn't booked an appointment by then, this specific route is no longer available to you.
What Happens to Great-Grandchildren Now
Great-grandchildren had no direct route through this law even while it was open, only children and grandchildren of exiles qualified. If a great-grandparent is your connection to Spain, residency-based naturalisation, not this closed route, was always the path that applied, and still is.

Spain is an EU member state, and Spanish citizenship carries full EU citizenship rights, including freedom of movement across the EU and EEA. Applications are submitted electronically through the Ministry of Justice's official portal (sede.mjusticia.gob.es), or, for residency-based routes generally, coordinated through the wider framework published on Spain's official citizen portal (administracion.gob.es).
