Your Paths to Spanish Nationality

Spanish Citizenship

Spanish Citizenship can be acquired through origin, marriage, residency, or a fast-track route for specific nationalities, each with a different residency timeline. Getting the right one matters, some routes take one year, others take ten.

THE BASICS

Spanish Citizenship Requirements — The Residency Timeline

10 Years

The General Rule

For most applicants, naturalisation by residency requires ten years of continuous, legal residence in Spain.

5 Years

Refugee Status

Recognised refugees qualify for a reduced five-year residency requirement.

2 Years

Ibero-American, Portuguese and Others

Nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Sephardic origin, and Portuguese citizens qualify after just two years.

1 Year

Spouses, Born in Spain, Grandchildren

Married to a Spanish citizen, born in Spain, or child/grandchild of Spaniards of origin. Grandchildren should check which route applies, see below.

A CRITICAL DISTINCTION

Children vs Grandchildren — Why the Difference Matters

Children of Spanish Parents — Never a Residency Requirement

If one of your parents was a Spanish citizen when you were born, you're Spanish by origin, automatically, with no residency requirement, regardless of where you were born or where you live now.

Grandchildren — The Direct Route Has Closed for New Applicants

This is where a lot of outdated guidance causes real problems. Grandchildren used to have a direct path to citizenship without living in Spain, through the Democratic Memory Law. That specific route is now closed to new applicants. Today, most grandchildren without a parent who registered as Spanish need to go through residency-based naturalisation instead, typically the reduced two-year route if eligible, which does require actually living in Spain.

A CLOSED CHAPTER

The Democratic Memory Law — Closed to New Applications

The Democratic Memory Law, known informally as the "Ley de Nietos," allowed descendants of Spaniards exiled under the Franco dictatorship to claim citizenship directly. The deadline for new applications closed on 22 October 2025.

If You Already Had an Appointment Before October 2025

If you booked your consulate appointment before the deadline, you can still complete your application, even if the appointment itself falls later, in some cases as late as 2029. If you hadn't booked an appointment by then, this specific route is no longer available to you.

What Happens to Great-Grandchildren Now

Great-grandchildren had no direct route through this law even while it was open, only children and grandchildren of exiles qualified. If a great-grandparent is your connection to Spain, residency-based naturalisation, not this closed route, was always the path that applied, and still is.

REQUIREMENTS

How Can You Get Spanish Citizenship — What's Required Beyond Time

01

The DELE A2 Language Exam

Basic Spanish proficiency, verified through the DELE exam at A2 level, applies to most residency-based applications, though not to citizenship by origin.

02

The CCSE Test on Spanish Culture and the Constitution

A test on Spanish culture, society, and the Constitution, required for naturalisation routes.

03

Clean Criminal Record

A background check from your country of residence, alongside the standard documentation for your specific route.

04

The Official Fee, Separate From Legal Support

The Spanish government's own application fee is €100. That's a state fee, not our legal fee, and we keep the two clearly separate in every quote.

GOOD TO KNOW

Spanish Nationality Law — The Legal Basis

Spanish nationality is governed by Articles 17 to 28 of the Spanish Civil Code. Spain is an EU member state, and Spanish citizenship carries full EU citizenship rights, including freedom of movement across the EU and EEA. Applications are submitted electronically through the Ministry of Justice's official portal (sede.mjusticia.gob.es), or, for residency-based routes generally, coordinated through the wider framework published on Spain's official citizen portal (administracion.gob.es). We work directly with both.

LATIN AMERICA

Spanish Citizenship for Latin America — The Fastest Route

If you're a national of an Ibero-American country, you have access to the shortest general path to Spanish citizenship. It's one of the most generous provisions in Spanish nationality law, and one of the least understood.

Frequently Asked Questions about Spanish Citizenship

Through origin (a Spanish parent), marriage to a Spanish citizen, residency-based naturalisation, or the reduced two-year route for Ibero-American and select other nationalities. Each has its own timeline and requirements.

The Spanish government charges an official fee of €100 to process the application. Beyond that, costs depend on the route, and on whether documents need translation, apostille, or genealogical research. We give you a full, itemised quote before anything is filed.

If you have a Spanish parent, citizenship by origin is the fastest route, no residency required at all. If not, marriage to a Spanish citizen (1 year) or the Ibero-American fast track (2 years) are the quickest routes that remain genuinely open.

No. The deadline for new applications closed on 22 October 2025. If you already had a consulate appointment booked before that date, you can still complete your case.

Yes. Portuguese nationals qualify for the reduced two-year residency route, rather than the standard ten years required for most applicants.

It depends on your nationality. Spain has historically been more restrictive than Portugal on this, but dual citizenship is permitted for Ibero-American nationals and a number of other specific countries and situations.
