Not Automatic, But Often Available
Portugal Birthright Citizenship
Portugal birthright citizenship isn't automatic. Whether a child born in Portugal qualifies depends on the parents' nationality and, in some cases, how long a parent has legally resided in Portugal.
THE BASICS
Does Being Born in Portugal Make You a Citizen?
No, not on its own. Portugal isn't an unconditional jus soli country the way much of the Americas is, where birthplace alone grants citizenship. Being born on Portuguese soil matters, but it's rarely the deciding factor by itself.
Portugal's Mixed System — Jus Sanguinis With Limited Jus Soli
Portuguese nationality law runs mainly on jus sanguinis, nationality passed through a parent, with a few specific, conditional exceptions based on where the birth takes place. Those exceptions are what this page is about.
Why "Birthright Citizenship" Is Misleading as a Search Term
The term gets borrowed from US and Canadian usage, where birth alone is enough. In Portugal, it never works that way on its own, so searching for "birthright citizenship" often sets the wrong expectation before you've even read the requirements.
AUTOMATIC CASES
When Citizenship by Birth Is Automatic
One Parent Is Portuguese
If either parent is a Portuguese citizen, the child is Portuguese by origin, automatically, regardless of where the birth takes place. No residency requirement applies here at all, this route sits outside everything else on this page.
Registering This With the Civil Registry
Even in this automatic case, the birth still needs to be formally registered, either in Portugal or at a Portuguese consulate abroad if the child was born outside the country. Automatic doesn't mean self-executing, someone still needs to file it.
THE 5-YEAR RULE
Portuguese Citizenship by Birth — The Two Scenarios That Depend on Your Parents' Residency
If neither parent is Portuguese, whether a child born in Portugal qualifies depends on one specific detail about the parents, and it's a detail most guides get wrong by treating it as one rule instead of two.
01
A Parent Also Born in Portugal — No 5-Year Requirement
If at least one parent was themselves born in Portugal and is resident there at the time of the birth, the child qualifies as Portuguese by origin, with no minimum residency period required. This is a distinct legal route from the one below, and a lot of guides online blend the two together incorrectly.
02
A Parent Not Born in Portugal — 5 Years of Legal Residence Required
If neither parent was born in Portugal, a child born there can still be Portuguese by origin if, at the time of birth, one parent has legally resided in Portugal for at least 5 years. What counts is the residence title, not just physical presence, a couple who arrived 6 years ago but only received their residence permit 4 years ago doesn't meet this requirement, because the 5 years are measured from the title, not the arrival date. This route also requires an active step the previous ones don't: the parents need to formally declare that they want the child to be Portuguese. It isn't automatic the way it was before 2026.
03
Why the Date of Birth Matters — Which Version of the Law Applies
The 5-year requirement only applies from 19 May 2026 onward. If your child was born before that date, the previous rule, generally one year of legal residence, applies instead. It's the law in force on the date of birth that governs, not the law in force today.
ANOTHER ROUTE
A Separate Path — Naturalization for Children in School
There's a distinct route, technically naturalization rather than citizenship by origin, for children born in Portugal who don't qualify under the scenarios above. If a parent has 5 years of legal residence and the child is enrolled in compulsory schooling in Portugal, naturalization may be available under this separate provision. It's a different legal mechanism from everything above it, worth knowing about if your situation doesn't fit neatly elsewhere.
SPECIAL CASES
Citizenship by Birth in Portugal to Prevent Statelessness
If a child born in Portugal would otherwise have no nationality at all, Portugal grants citizenship specifically to prevent that outcome, regardless of the parents' residency status.
WHAT TO DO NOW
Portugal Citizenship Born in Portugal — Registering the Birth
The 20-Day Registration Window
Births in Portugal need to be registered with the civil registry within 20 days. This applies regardless of which citizenship scenario applies to your child, registration is a separate, immediate step.
Documents You'll Need
Parents' identification documents, proof of the parents' residency status and duration where relevant, and, for the declaration-based route, the formal request confirming the parents want the child to hold Portuguese nationality.

Frequently Asked Questions about the Portugal Birthright Citizenship
Does a child born in Portugal automatically get citizenship?
Only in specific cases, if a parent is Portuguese, if a parent was also born in Portugal and resides there, or if a parent has met the 5-year residency requirement and formally declares it. Otherwise, no, birth in Portugal alone isn't enough.
How many years must a parent live in Portugal for their child to qualify?
If neither parent was born in Portugal, one parent needs at least 5 years of legal residence at the time of the child's birth, counted from the residence permit, not from arrival. If a parent was also born in Portugal, there's no residency requirement at all.
Can I get Portuguese citizenship through my child?
No, not directly. Your child's citizenship depends on your status, not the other way around. If you're wondering about your own path to citizenship, our citizenship by residence or citizenship by descent pages are more likely what you need.
What if my baby was born before May 2026?
The rules in force on the date of birth apply, not today's rules. Births before 19 May 2026 generally fall under the previous, less restrictive residency requirement. We can confirm exactly which version applies to your case.
